The Different Ways in Which One Can attain British Citizenship 

There are certain eligibility requirements that individuals have to fulfill if they want a British citizenship. Certain requirements are framed by the Home Office which needs to be fulfilled if you want to get registration as a British citizen. Some of the requirements are as follows – One of the major requirements is that you are born after 1st January, 1983 in UK. And another important requirement is that your parents either mother/father should be a resident of UK before you turn 18, so you have to apply for the registration before your 18th birthday. Your parents became a member of the armed forces after 13th January, 2010 is another criterion for registration. 

Naturalization - 

Foreigner’s who lived in UK can change their nationality by through legal process. There are also other ways in which one can attain British nationality and one such way is Naturalization as a British Citizen. In this process, the individual will be granted the similar legal rights and freedom, along with a status of a naturally by birth a British citizen. So, there are other ways also by which one can attain a British citizenship. For instance, you have gone to UK to study or for a job and you have stayed there for a period of 5 years or more, then you can apply for ILR which is indefinite leave to remain, where there will be no time limit restrictions for you to stay. 

Ways to Become British Citizen - 

This ILR is valid for a period of 2 years, but immediately after 1 year you can apply for British citizenship or if you want to permanently become a British national. Other ways in which you can get a British citizenship is through spouse/partner visa. In this it is important for you to show that you are married and your spouse is a permanent resident of UK. And, incase if you are in a relationship, then you have to prove that you are above 18 years of age and you are in a relationship since 2 years. 

Child Visa - 

Child visa is another way to enter in UK. But it is important to show that the parents or single parent is living in UK and has permanent residence. And the guardian of the child has to prove that the child is below 18 years and the child is financially unstable and is dependent on the parents residing in UK etc. And if you are above 18 years of age then there are other ways to apply for the visa. 

Eligibility Criteria for UK Spouse Visa, Appeal Process & Certain Demerits 

There are different kinds of visa that you will get for UK. And one such visa is also known as UK partner visa. It can also be called as UK marriage visa. It is a kind of a settlement visa which has been introduced by the government which allows a married person to live with their spouse in the UK. It is for up to 30 months. You can also get an extension of the UK partner visa for another 30 months, but there are certain eligibility conditions that you should have to qualify for the visa extension. You can also become eligible for indefinite leave to remain (ILR) and also get a citizenship in UK, but the first step that you have to follow is getting a partner visa. 

Eligibility for UK Spouse Visa - 

To be eligible for UK spouse visa, the first requirement is that you should be married or you should show that you are in a civil partnership with your spouse who should be have a citizenship of UK. Your spouse can also be a settled person in UK or the spouse can also be a UK refugee. There are certain criteria that you should fulfill which comprises of showing a proof that you are in an authentic relationship and you will also have show precise financial conditions and go through a medical test etc. 

Refusal of UK Spouse Visa - 

Many times people face refusal for a UK spouse visa & there can be many reasons for that like language test for good English that many people fail, also the income requirement, incorrect documents, etc. In such cases you can go for a UK spouse visa refusal appeal. You can approach the immigration tribunal and file an appeal within 28 days on the refusal of the UK spouse visa. Also, it is important that you present a strong appeal with proper grounds and justifications. 

Demerits of the Immigration Tribunal - 

One of the demerits of the immigration tribunal is that the appeals are decided within 6 months and in some cases it can also take long time. And it is a complete waste of time and money of the person appealing, in the first place. For instance, someone’s spouse is sick or on the deathbed, and the visa is refused due the grounds of precise financial conditions. So that person has to go through appeal procedures and wait for so long which is a mental agony in the first place.
